Free, Prior and Informed Consultation: An Effective Right to Participation or a Mere Legal Formality

Abstract

This article aims to analyze prior, free, and informed consultation (PFIC) in Ecuador, in order to determine whether it constitutes a genuine participatory right of Indigenous peoples and nationalities or whether, in practice, it is reduced to a mere formality. Based on its recognition in the 2008 Constitution and in international instruments such as ILO Convention 169 and the United Nations Declaration on the Rights of Indigenous Peoples, the study examines existing regulations, jurisprudential developments, and failed attempts at legal regulation. Throughout this research, it becomes evident that although PFIC is conceived as a collective right, the State retains the exceptional power to carry out extractive projects in the face of community opposition, provided it offers adequate justification or reasoning. Jurisprudence, both from the Inter-American Court of Human Rights (I/A Court H.R.) and the Constitutional Court of Ecuador, has defined the essential elements of the right, such as its prior character, good faith, and adequate information. However, the lack of a specific organic law generates legal uncertainty and allows the executive branch to undermine fundamental principles and guarantees.The article concludes that the effective exercise of the right to PFIC requires organic legislation and monitoring mechanisms that guarantee its effectiveness as a right of participation and environmental justice.
