The purpose of this paper is a dogmatic legal approach to the principle of resocialization within the penitentiary regime, that is, the conception of said principle as an essential goal in the system, for this we will focus on its historical background and the three main problems that this principle presents; first, is the purpose of resocialization the response to legitimize punishment? second, is
the resocialization principle a goal in itself or can it be accidentally joined by other goals? and third, what does resocialization even mean?
