The New Simplified Joint-Stock Company and Traditional Corporations

By 2019, ecuadorian legislation only knew five species of companies. However, the Ley Orgánica de Emprendimiento e Innovación, reforms this traditionalist conception, towards new societies that promote the formalization and development of companies. Thanks to this progression, currently, the Ecuadorian corporative law includes six types of companies with legal personality: the company in collective name; the company in a simple limited partnership and divided by shares; the limited company; the anonymous company; the mixed economy company and the S.A.S. In this conglomerate and in practice the most used are the last four, with a preponderance in the private sphere of the limited company, public limited company and the emerging S.A.S. For the purposes of this work, we will analyse the general characterization of each of them and discuss their main comparisons with respect to the legislative innovation of the new Company (S.A.S).
